Payment information (processed securely via Shopify Payments — we do not store card data)
Creative briefs, reference images, and project details you share with us

We also automatically collect certain technical data: IP address, browser type, pages visited, and time spent on our site via cookies and analytics tools.

4. Sharing Your Information

We do not sell your personal data. We may share it with trusted service providers (Shopify, payment processors, cloud storage) solely to operate our business. All third parties are contractually bound to protect your data.

5. Data Retention

We retain your personal data for as long as necessary to fulfill your order and comply with legal requirements (typically up to 7 years for financial records). Creative briefs and reference materials are deleted within 90 days of project completion unless you request otherwise.

6. Your Rights

1. Acceptance of Terms

By placing a commission or using our website, you agree to these Terms & Conditions. If you do not agree, please do not use our services.

2. Services

Paletteforge Art LLC provides custom digital illustration services including:

Custom digital illustrations and artwork creation
AI-assisted art concepts and character illustration
Book & album cover art, poster and print design
Wall art design, brand illustration, and concept art
Digital art commissions for businesses and individuals

All services are delivered remotely via digital file delivery. No physical products are shipped unless explicitly stated.

3. Commission Process

All commissions begin with a creative brief submitted by the client. We will confirm project scope, timeline, and pricing before work begins. Full or partial payment may be required upfront depending on project size.

4. Intellectual Property

Upon receipt of full payment, you receive a non-exclusive commercial license to use the delivered artwork for the agreed purpose. Paletteforge Art LLC retains the right to display the work in our portfolio unless a confidentiality agreement is signed. You may not resell, redistribute, or claim authorship of the artwork.

5. Revisions

Each commission includes up to two (2) rounds of revisions within the agreed scope. Additional revisions or scope changes will be quoted separately.

6. Turnaround Time

Estimated delivery times are provided at the start of each project. Timelines may vary based on project complexity and current workload. We will communicate any delays promptly.

7. Client Responsibilities

You are responsible for providing accurate and complete creative briefs, reference materials, and timely feedback. Delays caused by late client responses may extend the project timeline.

8. Prohibited Uses

You may not use our artwork for illegal purposes, hate speech, defamation, or any content that violates applicable laws. We reserve the right to refuse commissions at our discretion.

9. Limitation of Liability

Our liability is limited to the amount paid for the specific commission. We are not liable for indirect, incidental, or consequential damages arising from use of our services.

10. Governing Law

These terms are governed by the laws of the State of Missouri, USA. Any disputes shall be resolved in the courts of Greene County, Missouri.

Refund Policy

1. Nature of Our Services

Paletteforge Art LLC provides custom digital illustration services. Because each commission is created specifically for you, our refund policy reflects the bespoke nature of this work.

2. Before Work Begins

If you cancel your commission before we have started work, you are entitled to a full refund of any amount paid. Please contact us within 24 hours of payment to request a cancellation.

3. During the Project

If you cancel after work has begun but before delivery of the final files:

Sketch/concept stage: 50% refund of the total commission price
Linework/coloring stage: 25% refund of the total commission price
Final rendering stage: No refund, as the majority of work has been completed

4. After Delivery

Once final digital files have been delivered and approved, no refunds will be issued. If you are unsatisfied with the final result, please contact us — we will work with you to address concerns within the agreed revision scope.

5. Revisions vs. Refunds

We strongly encourage using your included revision rounds before requesting a refund. Our goal is your satisfaction, and we will make reasonable efforts to adjust the artwork to meet your brief.

6. Exceptions

Refunds may be issued in full in the following circumstances:

We are unable to complete your commission due to unforeseen circumstances on our end
The delivered work materially differs from the agreed brief with no resolution possible
A technical error resulted in duplicate payment

7. How to Request a Refund

To request a refund, contact us at contact@paletteforgeart.com with your order number and reason for the request. We will respond within 5 business days. Approved refunds are processed within 10 business days to your original payment method.
